Labuan IBFC – The Solution for Growing Asian Businesses in the Changing Global Tax Landscape

Q :
What is the practical avenue available to Co. Secs.in promoting Labuan companies to their clients or potential clients?
A :
Company secretaries can expand their businesses to offer Labuan as solution to clients by:
i. Apply for Labuan Trust Company license;
ii. Apply for Managed Trust Company license;
iii. Business tie – up with existing Labuan Trust/ Managed Trust Company.

Q :
I understand that there are Malaysian businesses using Labuan to list in overseas. Why they don't use local company and list in Bursa?
A :
Labuan investment holding company allows free flow of capital not restricted by exchange control hence more flexible to invest abroad. Foreign directors have benefits in terms of zero tax on director fee which will be very attractive to foreign investors.

Q :
What is the difference between Labuan foundation and Malaysian foundation?
A :
Malaysian foundation is established under Society Act or Company Limited by guarantee. Malaysian foundation is restricted to philanthropic activities only.

Labuan foundation is established under Labuan Foundation Act and may carry on all legal activities not limited to charity.

BVI and HK companies are popular among people using offshore. How is Labuan company compared to these two?
A :
Labuan Company is a special breed of company which is tuned as best of its kind because it allows commercial substance to be created. This is possible because Labuan as a midshore jurisdiction is supported by the good eco – system and infrastructure in Malaysia as well as robust and friendly business environment governed under Labuan Acts.
